Who pays council tax in a shared house?

For HMOs covered by England’s council-tax regulations, liability rests with the landlord. Ask the council to confirm how the rules apply to a particular home and bill.

The HMO rule and its limits

The government’s 2023 information letter explains the changes effective from 1 December 2023: covered HMOs are treated as one dwelling, with landlord liability. The definition broadly follows section 254 of the Housing Act 2004, but the licensing exemptions in Schedule 14 are not carried over. Section 257 self-contained flats are outside these changes.

Do not assume that the words “joint tenancy”, “separate room” or “licensed HMO” settle your bill. Give the council the actual occupancy and tenancy details and ask it to explain its decision. The Valuation Office’s guidance says most HMOs have one band; self-contained accommodation needs separate consideration.

Students and discounts

GOV.UK’s student guidance says an all-full-time-student household does not pay Council Tax. Mixed households can still have a bill and may qualify for a discount. A student label alone does not determine a particular bill.

Check who is disregarded and how to apply for a discount or exemption. Ask the council who is responsible and what evidence it needs. A council-tax decision does not itself tell you what your rent agreement includes.

If a bill seems wrong

Write to the council promptly, explaining why you believe the bill has the wrong person, amount or discount. Follow GOV.UK’s bill appeal route, including its payment instructions and deadlines. Continue the original payments until a replacement bill arrives. The guide also explains when you can appeal to the Valuation Tribunal.

Check the particular home

Confirm the quoted rent, which bills it includes and the council’s liability decision before budgeting. This is general guidance for England, not a ruling on an individual home, bill or exemption.

Official sources checked 15 October 2026. The council handles liability and discounts; banding questions go to the Valuation Office.

Common questions

Do tenants pay council tax in an HMO?
For HMOs covered by England’s council-tax regulations, liability rests with the landlord. Ask the council to confirm the rules for your particular home rather than relying on a general shared-house label.
What if I rent a whole house with friends on one tenancy?
Ask the council to confirm liability using the actual occupancy and tenancy details. Do not treat the words “joint tenancy” as a conclusive answer to whether the HMO rules apply.
Do I get a single-person discount in a shared house?
Discounts depend on the household, who is disregarded and who is liable. Ask the council what applies and what evidence it needs; do not assume every room tenant receives a separate discount.
I've been sent a council tax bill for my room — what do I do?
Contact the council promptly and explain why you think it has billed the wrong person. Follow GOV.UK’s appeal guidance and payment instructions; continue the original payments until a replacement bill arrives.
